Brief argues that state courts lack jurisdiction to rule on federal matters

Trump legal team files brief supporting dismissal of Georgia charges

Former President Donald Trump’s legal team is making moves to dismiss more charges in the Georgia election interference case, filing a supplemental brief in support of dropping two counts against him. The brief argues that the state of Georgia does not have the authority to punish someone for federal crimes, such as lying under oath, as that falls under the jurisdiction of the federal government.

The brief cites legal precedents from the 1800s and a more recent case from 2008 to bolster Trump’s argument that the charges against him should be dropped. Trump’s legal team has declined to comment on the brief, which was filed on April 24.

Trump and 18 others were indicted in August 2023 for interfering in the 2020 Georgia presidential election. While some of Trump’s codefendants have entered guilty pleas and made deals with the Fulton County District Attorney’s Office, Trump’s trial has been delayed due to controversy surrounding the DA’s relationship with her former special prosecutor and the numerous motions filed in connection to the case.

At this time, it is unclear when Trump might go on trial in Georgia. In the meantime, Trump is currently on trial in New York City for allegedly falsifying business documents in connection to payments made to adult film star Stormy Daniels.
