In a dramatic turn of events, Kari Lake’s attorney argued before the state Court of Appeals that new evidence reveals Maricopa County election officials conducted unannounced tests on vote-counting equipment that ultimately failed on Election Day. This revelation has prompted Lake’s legal team to push for a do-over of the 2022 governor’s race, which she lost to Democrat Katie Hobbs.

Attorney Kurt Olson alleged that the county’s election director provided false testimony to the judge overseeing Lake’s election contest lawsuit. He also claimed that the judge improperly discounted testimony from Lake’s expert and used the wrong standard in evaluating the validity of Lake’s claims.

According to Olson, the problems with ballot printers and vote tabulators led to long lines and chaos at polling places on Election Day, causing many voters, particularly Republicans who would have supported Lake, to leave without casting their ballots. This, he argued, created enough doubt in the election results to warrant setting them aside.

Deputy Maricopa County Attorney Thomas Liddy vehemently refuted Olson’s claims, calling them “hogwash” and asserting that all ballots were counted, either by the machines at vote centers or at the county’s central counting location. Liddy emphasized that not a single ballot was rejected and that Lake’s legal team is attempting to resurrect baseless claims about the election results.

The Court of Appeals faces the challenge of determining whether the trial judge erred in rejecting Lake’s bid for a new trial. While Olson presented new evidence to the appellate court, the judges emphasized that their role is not to conduct fact-finding but to assess whether the trial judge acted in error.

Despite conflicting testimonies and expert opinions, the core issue at hand is whether Maricopa County properly tested the vote tabulation machines as required by law. Olson argued that the county failed to adhere to testing protocols, leading to widespread malfunctions on Election Day.
