Arizona GOP successfully appeals state high court sanctions in 2020 election challenge

Arizona Supreme Court Reverses Sanctions Against Arizona Republican Party in Election Procedures Case

The Arizona Supreme Court has made a significant ruling in favor of the Arizona Republican Party, overturning lower court decisions that imposed over $27,000 in sanctions and attorney fees related to the party’s challenge of Maricopa County election procedures following the 2020 election.

In a unanimous decision issued on Thursday, Justice John Lopez emphasized the importance of allowing parties to raise questions about the interpretation and application of election laws without facing financial penalties. The ruling stated that even if such challenges are deemed unlikely to succeed, they are a legitimate use of the judicial system and not indicative of bad faith.

The case originated from a lawsuit filed by the state GOP alleging that Maricopa County mishandled a required hand-count of ballots by sampling votes from county-wide centers rather than precincts. Despite the county’s demonstration of the accuracy of its ballot counting machines through various tests, a lower court dismissed the case in 2021 and awarded attorney’s fees to the Secretary of State’s office.

Subsequent appeals upheld the dismissal and imposed additional sanctions on the Republican Party, leading to the recent Supreme Court decision. While the high court did not reverse the dismissal of the case, it clarified that questioning election procedures through legal means is not a threat to the rule of law, even if the claims are considered unlikely to succeed.

The Arizona Republican Party welcomed the ruling, stating that it reaffirms the party’s right to seek clarification on election laws and procedures. The decision serves as a reminder of the importance of upholding the legal principle of allowing parties to challenge and seek clarification on laws without fear of financial repercussions.
